  Terms and conditions for the provision of electronic services by Młyńska12.pl  

1. Preliminary Provisions
1.1. Młyńska12 is a service owned by TWELVE Spółka z ograniczoną odpowiedzialnością, with its registered office in Mogilno, ul. 900-Lecia 36, 88-300 Mogilno, entered in the Register of Entrepreneurs of the National Court Register under number KRS 0001027433, REGON: 524883844, NIP: 5571708166.

1.2. These Terms and Conditions define the rules and technical conditions for the provision of electronic services by Twelve Sp. z o.o. via the Młyńska12.pl website, the terms of use by Users, and the complaint procedure.
1.3. Every User is obliged to comply with these Terms and Conditions from the moment they begin using any services offered through Młyńska12.pl, particularly when they begin transmitting data.
1.4. Copyright and all intellectual property rights to the Młyńska12.pl website belong entirely to Twelve Sp. z o.o.


2. Definitions
Unless the context clearly states otherwise, the terms used in these Terms and Conditions have the meanings defined below:
2.1.1. Twelve Sp. z o.o. – TWELVE Spółka z ograniczoną odpowiedzialnością, registered as described in point 1.1.
2.1.2. Młyńska12.pl – the online platform operated by Twelve Sp. z o.o., providing the ability to purchase tickets for events.
2.1.3. User – an individual or entity who meets the conditions set forth in these Terms and has accepted them, and who has made a reservation and placed an order.
2.1.4. Event – an event organized by Twelve Sp. z o.o. via the Młyńska12.pl platform, including but not limited to concerts, conferences, promotional, cultural, culinary, integration or sports events, festivals, etc. Events may be paid or free of charge.
2.1.5. Confirmation email – a document confirming the conclusion of a contract between the User and Twelve Sp. z o.o., entitling the User to participate in the Event.


3. Rights and Obligations of the User and Twelve Sp. z o.o.
3.1. The User is obliged to:
3.1.1. Provide accurate and non-misleading information during registration and when using Młyńska12.pl.
3.1.2. Confirm the reservation by paying the full amount within 3 days of making the reservation and sending payment confirmation to recepcja@mlynska12.pl.
3.1.3. Failure to make payment will result in the cancellation of the reservation. 3.2. Twelve Sp. z o.o. reserves the right to modify the services offered on Młyńska12.pl and to provide services that may differ from those available at the time of User registration, under the terms set out in these Terms. 3.3. The owner of the Młyńska12 venue, where Events take place, may specify rules for using the premises. In such cases, those rules apply to all participants. These rules may be published on the Event page. 3.3.1. Certain Events may also be subject to additional regulations arising from applicable legal provisions, including the Act of 20 March 2009 on the safety of mass events.


4. Personal Data Processing
4.1. The rules for personal data processing are described in the Privacy Policy section of the Młyńska12.pl website.  


 5. Liability Rules
5.1. Twelve Sp. z o.o. shall not be held liable for damages arising from the incorrect use, inability to use, or improper functioning of the Website due to force majeure, the User's fault, or other reasons not attributable to Twelve Sp. z o.o.
5.2. Twelve Sp. z o.o. shall not be liable for the provision of false data by the User.


6. Reservations via Młyńska12.pl
6.1. In order to use the Młyńska12.pl platform to book participation in an Event, the User must accept these Terms and Conditions.
6.2. By making a reservation for an Event, the User enters into a contractual relationship with Twelve Sp. z o.o.
6.3. Twelve Sp. z o.o. declares that it is the organizer of the Events available on Młyńska12.pl, unless explicitly stated otherwise in the Event details.
6.4. Users are not entitled to withdraw from the agreement with the Organizer, in accordance with Article 38 point 12 of the Polish Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, item 827), which excludes the right of withdrawal for contracts concerning leisure services, entertainment, sports, or cultural events where the contract specifies a particular date or period of performance.


7. Payment Methods
7.1. When purchasing Event tickets from Twelve Sp. z o.o., the following payment methods may be available:
7.1.1. Credit/debit card payment – via an external electronic payment provider.
7.1.2. Quick transfer – online bank transfer through a supported payment provider.
7.1.3. Traditional transfer – standard offline bank transfer to the account of Twelve Sp. z o.o.
7.2. Twelve Sp. z o.o. is not responsible for the execution or security of transactions carried out by external payment providers, including the provision of card data on third-party websites.
7.3. The payment operator is solely responsible for credit card transaction processing on its own platform, according to its own terms and conditions.
7.4. Certain payment methods may not be available for specific Events. Detailed payment options will be shown during the reservation process. Any transaction-related fees are the sole responsibility of the User.


8. Liability
8.1. Full responsibility for the Event lies with its Organizer.
8.2. Details such as Event information, ticket availability, pricing, and payment options are determined by the Organizer.
8.3. The name, address, and identification details of the Organizer are available to the User via the Evenea platform.


9. Refunds
9.1. In the case of Event cancellation, Twelve Sp. z o.o. bears sole responsibility for refunding the User. If the Event date changes and the User requests a refund, Twelve Sp. z o.o. is also responsible for the refund or, with the User’s consent, may offer a voucher equal to the amount paid.


10. Changes to the Terms and Conditions
10.1. Twelve Sp. z o.o. reserves the right to amend these Terms and Conditions, in particular in relation to launching new versions of services offered on Młyńska12.pl.
10.2. Any amendments become effective on the date specified by Twelve Sp. z o.o., which shall not be earlier than 7 days from the date the updated Terms are published on Młyńska12.pl. Events started before the effective date of the new Terms will be governed by the previous version.
10.3. Users will be informed of changes to the Terms via the Młyńska12.pl website. If a User does not object within the specified period, it is assumed that they accept the updated Terms.


11. Complaints Procedure
11.1. The User may submit complaints regarding services provided by Twelve Sp. z o.o.
11.2. Complaints may be submitted in writing to the contact address provided in the Event description and should include a description of the issue.
11.3. If additional information is required, Twelve Sp. z o.o. may request that the User supplement their complaint.
11.4. Complaints will be reviewed within 14 days of receipt.
11.5. Responses will be sent only to the email address provided in the complaint.
11.6. If a User who is a consumer submits a complaint that is not upheld by Twelve Sp. z o.o., they may use out-of-court dispute resolution methods.
11.7. These include, but are not limited to: 12.7.1. Proceedings before a permanent consumer arbitration court at the Trade Inspection,
11.7.2. Mediation initiated by a regional Trade Inspectorate,
11.7.3. Assistance from a consumer ombudsman or consumer protection organization (e.g. Consumer Federation, Polish Consumer Association),
11.7.4. Online Dispute Resolution (ODR) through authorized platforms.
